1. Service provider

In compliance with applicable law, this website is owned by [COMPANY NAME], with registered address at [ADDRESS], Tax ID [TAX ID], hereinafter referred to as SinKash.

2. Purpose and scope

These Terms of Service govern access to and use of the SinKash platform, a cashless payment system using NFC technology designed for consumption management at events, festivals, and organisations.

Accessing this website constitutes acceptance of all provisions included in these Terms. If you disagree with any of the conditions set out here, you must not use this website or contract our services.

3. Service description

SinKash provides event organisers with a platform that enables:

  • Managing attendees and assigning them NFC cards or wristbands
  • Configuring products, prices, and consumption limits per user
  • Recording and processing consumptions in real time without cash
  • Consulting reports and consumption statistics from an administration panel

The service is provided on a B2B basis: the direct client is the event organiser, not the end attendee.

4. Registration and access

To access the administration panel, the organiser must register by providing truthful, complete, and up-to-date information. Users are responsible for maintaining the confidentiality of their access credentials and for all activities carried out under their account.

SinKash reserves the right to suspend or cancel access for any user who provides false information or makes improper use of the service.

5. User obligations

The user agrees to:

  • Use the service in accordance with the law, morality, and public order
  • Not carry out activities that may damage, disable, or overload the platform
  • Not attempt to access restricted areas of the system or other users’ accounts
  • Comply with applicable data protection regulations regarding event attendees
  • Notify SinKash of any unauthorised use of their account

6. Pricing and billing

The service price is agreed individually with each client according to the event conditions (number of attendees, duration, required features). The specific economic conditions are set out in the quote or contract signed between the parties.

SinKash will issue the corresponding invoices within the agreed timelines. Non-payment may result in service suspension.

7. Intellectual property

All content on the website and platform — including texts, images, logos, source code, design, and software — is the property of SinKash or its licensors and is protected by applicable intellectual and industrial property laws.

Reproduction, distribution, public communication, or transformation without express written authorisation from SinKash is prohibited.

8. Disclaimer of warranties and liability

SinKash does not guarantee continuous and uninterrupted availability of the platform, although it will take reasonable measures to minimise any disruption. No liability will be accepted for damages arising from:

  • Service interruptions due to force majeure or third-party failures
  • Improper use of the platform by the user
  • Failures in the user’s devices or networks

9. Service and terms modifications

SinKash reserves the right to modify, suspend, or discontinue the service at any time, as well as to update these Terms. Changes will be communicated with reasonable prior notice. Continued use of the service after changes are published implies acceptance of the new Terms.

10. Termination

Either party may terminate the contractual relationship with [X] days written notice. SinKash may terminate the contract immediately in the event of a serious breach by the user.

11. Governing law and jurisdiction

These Terms are governed by Spanish law. For the resolution of any dispute, the parties submit, with express waiver of any other jurisdiction, to the Courts and Tribunals of [CITY].
